The zeal for children's education in Korea is very high. This situation makes the demand for textbooks and test questions bigger and bigger, which are illegally used by private educational institutes and online educational companies. The Ministry of Education, Science and Technology(aka MEST) and the education bureaus of cities and provinces are copyright holders on test questions of national and public schools. Even governmental organization, if it is a third party, has to ask a permission to use them in advance. However the MEST does not manage copyright control: the procedure for legitimate use is very complicated and the control against piracy is inadequate. Related organizations such as the National Assembly now refer to the control of copyright on textbooks and test questions as one of countermeasures for private education. So, control and effective management systems must be established without delay. This paper compares related overseas cases and analyzes the organizing situation of domestic legislation involved in PSI. In the positive stance on commercial use, the application of centralized management system is highly recommended and some interest adjustments among related people, the training of persons in charge, promotions for the system must be provided as well.
