Destiny of the Constitution of Korea amended in 1987 Byun, Hae-Cheol The Constitution of Korea has arrived at its present form as the result of being amended nine times. The latest amendment on October 29, 1987 was the result of Movement of democratization in 1980's, especially the civil resistance on June, 1987. Based on the people's consensus, the Constitution of 1987 has had a strong executing force in comparison with the former Constitutions. Particularly, the Constitutional Court has contributed on the enhancement of people's fundamental rights, controling the constitutionality of the legislative and executive powers. the sovereignty residing in the Korean people has been realized by extending the right to vote to the people over 19 years old and introducing some kinds of direct democracy(local referendum, local recall, etc.) Nowadays, the Constitution of 1987 has faced a new challenge of revision which allows a President to be reelected. However most people do not agree with the idea when it comes to revising it during term of the actual president. We know that a simple re-electability could not assure the political responsibility of the President. The people have to more chances to participate in exercising the State power, including the judicial power(participation in a trial, etc.). An information-oriented society and the polarization of our society resulting in the conflicts of fundamental rights, the harmonization and cooperation is required between different generations, sexes, regions, etc.
