국회는 2006.12. 노사관계선진화방안에 관한 법률들을 통화시켰다. 2006.12.30. 개정 노동조합및노동관계조정법은 기존의 노조법과 같은 태도를 취하였다. 노동조합및노동관계조정법 하에서 한국 노동자들은 헌법이 보장한 노동기본권의 행사가 심각하게 제한받고 있다. 노동기본권의 행사가 예외적으로 보장되고 있다. 개정법의 입법취지는 선진화된 노사관계법제도를 세우는 것이었다. 하지만 개정법은 선진적인 것이 아니라 오히려 퇴보적이다. 노사관계법제도선진화연구보고서상 노사관계선진화연구위원회, 노사정위원회, 심지어는 민주노총까지도 원칙적으로 노동기본권의 행사가 보장되어 있지 않음에 대한 올바른 인식이 없었다. 이로 인하여 개정법은 노동기본권 행사에서 여전히 많은 문제점들을 갖고 있다.


‘Trade Union And Labor Relations Adjustment Act’ Amended on Dec. 30, 2006 and Fundamental Rights of Workers Kim, Gi-deog Attorney at law, Legal Center, Korean Metal Worker’s Union The National Assembly voted to pass the bills on roadmap for advancement of industrial relations on Dec. 2006. The ‘Trade Union And Labor Relations Adjustment Act’ amended on Dec. 30, 2006 held fast to stance of Korea’s former Act. Under the ‘Trade Union and Labor Relations Adjustment Act’, Korea’s laborers are thoroughly restricted in the use of their fundamental labor rights that the Constitution of the Republic of Korea guarantees. The Use of fundamental labor rights is secured only exceptionally. The amended Act has proposed the advanced industrial relations laws and systems in Korea. But the amended Act is not so much ‘advanced’ as ‘retrogressive.’ The ‘Research Committee on Industrial Relations System Development’ in the Report of Roadmap for Industrial Relations Laws and Institutions, the tripartite representatives meeting, and even the Korea Confederation of Trade Union did not have a correct understanding of non-guaranteeing for the use of fundamental rights of laborers in principle. Out of this amended Act arose many questions in the use of Labor fundamental Rights like before.
