지문채취는 신체의 자유와 프라이버시권을 침해하는 강제처분이므로 법관이 발부하는 영장에 의하여야 함에도 불구하고 이러한 요건이 충족되지 않은 수사기관의 지문 채취 요구에 불응하였다고 하여 형사처벌하는 것은 헌법상 보장된 영장주의와 적법절차원칙에 위반된다는 것이라고 할 것이다.이 글에서는 우선 지문채취에 대하여 이러한 비판이 있어 왔고,攀 백형구, “지문채취”, 사법행정, 1985/10(통권298호), p.5.攀攀 또한 근래에는 자기정보결정권에 대한 침해라고 하는 비판攀 이인호, “주민등록번호지문날인과 개인정보자기결정권”, 인터넷법률 제8호(2001.9), pp.64-66.攀攀까지 있음에도 불구하고 수사기관이 지문을 채취해야만 하는 필요성을 최근 언론에 보도된 사례를 중심으로 살펴보고자 한다. 다음으로 현행법에 대한 해석론으로 지문채취의 법적 근거가 있다고 할 것인지를 고찰하고 그에 대한 문제점을 지적하고자 한다. 끝으로 입법론으로서 지문채취에 대한 입법례를 고찰하고 어떻게 법을 개정하는 것이 바람직한지 고찰하고자 한다.


The Legal Ground and Problem of the Fingerprinting in the Criminal Investigation * Assistant Professor, Korea National Police University Moon, Seong-Do* Two months ago I was asked by a police officer in my lecture on criminal procedure on what code a policeman could fingerprint a suspect in the criminal investigation. Recently the problem of the fingerprinting in the criminal investigation evokes the passionate debate about the balance prerogatives of the government and the liberty of the individual in Korea. This study reviews the legal ground and problems of the fingerprinting in the criminal investigation, and suggests improvement proposals on the regulation of the fingerprinting. In the second chapter the reason of the fingerprinting in the criminal investigation is explained. In the third chapter the legal ground and problems of the fingerprinting in the criminal investigation is examined. In the fourth chapter the japanese and the german criminal procedure code regarding the fingerprinting are introduced and improvement proposals on the regulation of the fingerprinting in the criminal investigation are suggested.
