ABSTRACT
It belongs to each ministry’s authority under the overall control of the prime minister to interpretate the administrative Acts and their subordinate statue on the condition of judicial review. By reason of the above, the administrative disposition has special legal effects(for example; authentication power or default-free validity, self-enforcement power), different from legal act such as contracts between private persons, or private person and public subject. Anyway, I may come to conclusion on the following ground that the final and authoritative legal interpretation power within the government is exercised by the legislative agency under the name of prime minister, and that the power may be expended to the administrative Acts and their subordinate statue under the minister of justice, and the mandated regulations of local government. 1. The legal interpretation by legislative agency as a final-authoritative interpretation within government is similar to the legal interpretation of the supreme court. 2. Most citizen pay high trust and respect to the legal interpretation by legislative agency and they believe that it has quasi legal power based on §4 Administrative procedure Act. 3. The legal interpretation by legislative agency has a de facto effective power within the government and over the citizen, until the court judge it as false or against the based law. In addition, the commission on the legal interpretation shall be endowed with legal status and in the point of mutual respect between the national powers it shall be prescribed that the court may follow the legal interpretation by legislative agency without substantial evidence to prove the defect of it.
